ALLGEMEINE GESCHAEFTSBEDINGUNGEN (AGB)

§1 Geltung
Fuer die geschaeftliche Beziehung zwischen Voltage Controlled Records / Daniel Wunder (nachfolgend Voltage Controlled Records) und dem Besteller gelten ausschliesslich die nachfolgenden allgemeinen Geschaeftsbedingungen soweit im einzelnen keine abweichenden Bestimmungen in Schriftform getroffen werden.


§2 Vertragsabschluss
1. Bei Voltage Controlled Records kann per Email, Telefon oder Fax bestellt werden. Die bei Voltage Controlled Records eingehende Bestellung ist ein an Voltage Controlled Records gerichtetes Angebot zum Abschluss eines Kaufvertrages.
2. Der Kaufvertrag kommt zwischen Voltage Controlled Records und dem Besteller ausschliesslich dadurch zustande, dass Voltage Controlled Records die bestellte Ware an den Besteller versendet. Die Versendung erfolgt an die von Besteller zuletzt mitgeteilte Adresse. Ueber Waren, die bestellt aber in der Sendung nicht enthalten sind, kommt kein Kaufvertrag zustande. Vertragspartner sind der Besteller und Voltage Controlled Records.
3. Die Abgabe von Waren erfolgt nur in fuer den Verkauf an Endverbraucher ueblichen Mengen.


§3 Widerruf, Widerrufsfolgen
1. Der Besteller kann den Vertrag innerhalb von einem Monat nach dem Erhalt der Ware schriftlich (auch per Email) oder durch die Ruecksendung der Ware widerrufen. Fuer die Wahrung der Widerrufsfrist genuegt die rechtzeitige Absendung des Widerrufs oder der Ware. Der Widerruf muss nicht begruendet werden. Die Frist von einem Monat, innerhalb welcher der Besteller den Widerruf schriftlich (auch per Email) oder durch die Ruecksendung der Ware erklaeren kann, beginnt mit dem Erhalt der Ware und der Widerrufsbelehrung.
2. Der Besteller hat die regelmäßigen Kosten der Rücksendung zu tragen, wenn die gelieferte Ware der bestellten entspricht und wenn der Preis der zurueckgesendeten Waren einen Bruttobetrag von 40,00 EURO nicht uebersteigt oder wenn der Besteller bei einem hoeheren Preis zum Zeitpunkt des Widerrufs noch nicht die Gegenleistung oder eine vertraglich vereinbarte Teilzahlung erbracht hat. Anderenfalls ist die Ruecksendung fuer den Besteller kostenfrei.
3. Ein Widerrufsrecht besteht nicht bei Vertraegen zur Lieferung von Audio- oder Videoaufzeichnungen (Schallplatten, CD' s), sofern die gelieferten Datentraeger versiegelt waren und vom Besteller entsiegelt worden sind.


§4 Lieferung, Versandkosten, Lieferzeit
1. Soweit nicht anders vereinbart, erfolgt die Lieferung ab dem Lager von Voltage Controlled Records an die vom Besteller angegebene Lieferadresse. Kosten fuer Mehraufwendungen, die entstehen, weil der Besteller oder eine andere zur Entgegennahme bereite Person zum Zeitpunkt der Zustellung nicht an der angegebenen Lieferadresse angetroffen wird, hat der Besteller zu tragen.
2. Der Besteller hat grundsaetzlich die Versandkosten zu tragen. Die Kosten fuer den Versand teilt Voltage Controlled Records dem Besteller in der Bestellbestaetigung mit. Die Kosten richten sich nach der vom Besteller gewuenschten Versandart und der Groesse und dem Gewicht der zu versendenen Bestellung. Wenn vom Besteller nicht anders gewuenscht, versendet Voltage Controlled Records auf dem guenstigsten Wege mit der Deutschen Post, DHL, DPD oder anderen Paketdiensten. Soll der Versand auf Wunsch des Bestellers ueber besondere, von ihm bestimmte Dienstleister erfolgen (z.B. Expressdienste), traegt der Besteller die Mehrkosten. Diese Kosten teilt Voltage Controlled Records dem Besteller auf dessen Anfrage hin mit.
3. Voltage Controlled Records teilt dem Besteller in der Bestellbestaetigung die zu erwartende Lieferzeit mit. Voltage Controlled Records legt dafuer die Standardlieferzeitangaben des gewaehlten Versenders zugrunde. Voltage Controlled Records uebernimmt jedoch keine Gewaehrleistung fuer die Einhaltung eines Liefertermins. Voltage Controlled Records uebernimmt keine Haftung fuer nicht versichert verschickte Waren.

§5 Zahlung, Faelligkeit und Verzug, Gebuehren im Zahlungsverkehr
1. Alle Preise sind in EURO inkl. 19% Mehrwertsteuer angegeben. Voltage Controlled Records behaelt sich das Recht vor, die angegebenen Preise jederzeit zu aendern.
2. Der Besteller kann den Kaufpreis ausschliesslich nur per Vorkasse durch Bankueberweisung oder per Vorkasse durch Paypal-Zahlung bezahlen. Voltage Controlled Records akzeptiert nur Zahlungen in EURO Waehrung.
3. Kommt der Besteller in Verzug, ist Voltage Controlled Records berechtigt, Verzugszinsen in Hoehe von 5% ueber dem von der Europaeischen Zentralbank bekannt gegebenen Basiszinssatz per annum zu fordern. Wenn Voltage Controlled Records einen hoeheren Schaden (z.B. aufgrund von Ruecklastschriften) nachweist, kann Voltage Controlled Records den Ersatz dieses hoeheren Schadens anstelle der Verzugszinsen verlangen.
4. Der Rechnungsbetrag ist mit dem Erhalt der Rechnung, welche der versendeten Ware beigefuegt ist, zur Zahlung faellig.
5. Ggf. anfallende Gebuehren bei Bankueberweisungen aus dem Ausland traegt der Besteller in voller Hoehe. Bei Zahlung per Paypal berechnet Voltage Controlled Records dem Besteller eine Pauschale fuer die anfallenden Gebuehren abhaengig von der Hoehe des Bestellwertes. Die Gebuehren werden dem Besteller von Voltage Controlled Records in der Bestellbestaetigung vorab mitgeteilt.

§6 Aufrechnung, Zurueckbehaltung
Dem Besteller steht das Recht zur Aufrechnung nur zu, wenn seine Gegenansprueche rechtskraeftig festgestellt oder von Voltage Controlled Records unbestritten sind.


§7 Eigentumsvorbehalt
Die gelieferte Ware bleibt bis zur vollstaendigen Bezahlung des Kaufpreises Eigentum von Voltage Controlled Records.

§8 Maengelhaftung
1. Fuer Maengel an der Kaufsache gelten die gesetzlichen Vorschriften (§§ 434 ff BGB). Die Abtretung dieser Ansprueche ist ausgeschlossen. Soweit sich nachstehend nichts anderes ergibt, sind weitergehende Ansprueche des Bestellers, zum Beispiel Ansprueche auf Ersatz von Mangelfolgeschaeden, ausgeschlossen. Voltage Controlled Records haftet insoweit nicht fuer Schaeden, die nicht an der Kaufsache selbst realisiert sind.
2. Voltage Controlled Records weist darauf hin, dass trotz aller aufgewendeten Sorgfalt bei der Fuehrung des Sortiments es im Einzelfall nicht auszuschliessen ist, dass sich in Audio- oder Videoaufzeichnungen bzw. in Drucksachen Inhalte befinden, welche gegen Normen des Rechts oder gegen die guten Sitten verstossen oder jugendgefaehrdend sein koennen. Voltage Controlled Records uebernimmt ausdruecklich keine Garantie dafuer, dass sich Inhalte der vorgenannten Art nicht in gelieferten Audio- oder Videoaufzeichnungen bzw. in gelieferten Drucksachen befinden. Die Geltendmachung von darauf beruhenden Schadensersatzanspruechen ist ausgeschlossen.
3. Voltage Controlled Records weist weiterhin darauf hin, dass trotz aller aufgewendeten Sorgfalt bei der Fuehrung des Sortiments es im Einzelfall nicht auszuschliessen ist, dass Audio- oder Videoaufzeichnungen bzw. Drucksachen unter Verletzung von Urheber- oder Leistungsschutzrechten hergestellt sein koennen. Voltage Controlled Records uebernimmt ausdruecklich keine Garantie dafuer, dass die gelieferten Audio- oder Videoaufzeichnungen bzw. die gelieferten Drucksachen frei von Verstoessen gegen Urheber- oder Leistungsschutzrechte sind. Die Geltendmachung von darauf beruhenden Schadensersatzanspruechen ist ausgeschlossen.
4. Vorstehende, in den Absaetzen 1 bis 3 geregelten Haftungsausschluesse oder Haftungsbeschraenkungen gelten auch fuer Arbeitnehmer, Vertreter und Erfuellungsgehilfen von Voltage Controlled Records.
5. Vorstehende, in den Absaetzen 1 bis 4 geregelten Haftungsausschluesse oder Haftungsbeschraenkungen gelten nicht, soweit Schaeden durch vorsaetzliches oder grob fahrlaessiges Verhalten verursacht worden sind oder ein Personenschaden vorliegt oder Rechtsverletzungen bzw. Verstoesse gegen die guten Sitten vorsaetzlich oder grob fahrlaessig begangen worden sind. Sie gelten weiterhin dann nicht, wenn der Besteller Ansprueche aus §§ 1 und 4 des Produkthaftungsgesetzes geltend macht.
6. In den Faellen, in denen Voltage Controlled Records Nacherfuellung im Wege der Ersatzlieferung leistet, ist der Besteller verpflichtet, die zuerst gelieferte Ware auf Kosten von Voltage Controlled Records innerhalb von 30 Tagen nach Erhalt der Ersatzlieferung an Voltage Controlled Records zurueck zu liefern.
7. Ansprueche, welche wegen Maengeln geltend gemacht werden, verjaehren in zwei Jahren, gerechnet ab dem Zeitpunkt, in dem der Besteller die Lieferung erhalten hat.

§9 Datenschutz
Persoenliche Daten, die Voltage Controlled Records von Bestellern erhebt und erfasst, dienen ausschliesslich nur der Bearbeitung und der Abwicklung der Bestellung einschliesslich der Liquidierung von Liefer- bzw. Kaufpreisforderungen sowie der Verfolgung von gegebenenfalls daraus resultierenden weiteren Anspruechen von Voltage Controlled Records.

§10 Anwendbares Recht
Es gilt unabhaengig vom Sitz oder Wohnsitz des Bestellers deutsches Recht unter Ausschluss des UN-Kaufrechts.

TERMS AND CONDITIONS

§1 Applicability
The present General Terms and Conditions shall apply exclusively to all business relations between Voltage Controlled Records /  Daniel Wunder (hereinafter referred to as Voltage Controlled Records) and its purchaser. Provisions differing from those indicated in our General Terms and Conditions cannot be accepted unless agreed on by Voltage Controlled Records and the purchaser in writing, in individual cases.

§2 Contract Conclusion
1. Orders can be placed with Voltage Controlled Records by email,  telefax or  telephone. An incoming order to Voltage Controlled Records constitutes an offer to conclude a sales contract with Voltage Controlled Records.
2. The sales contract between Voltage Controlled Records and the purchaser shall exclusively be brought about if Voltage Controlled Records dispatches the ordered goods to the purchaser. The consignment will be sent to the last address that the purchaser has given to Voltage Controlled Records. A contract will not be concluded for any goods that have been ordered but that are not included in the consignment. The contractual partners are the purchaser and Voltage Controlled Records.
3. Goods are only sold in the amounts that are usually made available to end-consumers.

§3 Revocation, Revocation Consequences
1. The purchaser can revoke the contract within a month after receipt of the goods. The revocation must be effected in writing (also by e-mail) or by returning the goods. To comply with this term, it is sufficient to send the written revocation or return the goods within the stipulated period. No reasons have to be given for the revocation. The time limit of one month within which the purchaser can revoke in writing (also by e-mail) or by returning the goods commences with the receipt of the goods and the revocation instructions.
2. The purchaser is obliged to pay the usual costs of the return consignment, if the delivered goods correspond to the ordered goods and if the value of the returned goods has a gross amount of up to 40,00 EURO or if, at the time of revocation and in the case of a higher value of returned goods, the purchaser has not paid the respective price or an instalment that has been contractually agreed on. The return consignment is otherwise free of charge for the purchaser.
3. There is no right of revocation for contracts for the delivery of audio or video recordings (vinyl records, CD's etc), if the delivered data carriers were sealed and the purchaser has unsealed them.



§4 Delivery, Cost Of Delivery, Time Of Delivery
1. Insofar as nothing else is agreed on, the consignment will be sent from the Voltage Controlled Records warehouse to the delivery address indicated by the purchaser. The purchaser will be charged for any additional costs that accrue, if the purchaser or other assigned person is not present at the indicated delivery address when the goods are delivered.
2. The purchaser has to pay for all delivery costs. Voltage Controlled Records will inform the purchaser about these costs in the order confirmation. The delivery costs depend on the required shipping option as well as on the size and weight of the consignment. If not otherwise required by the purchaser, Voltage Controlled Records uses the cheapest shipping option available with Deutsche Post, DHL, DPD or any other parcel service. The purchaser has to pay for any additional costs that accrue due to special forms of delivery requested by the purchaser (e.g. express delivery). Voltage Controlled Records will inform the purchaser about these costs on request.
3. In the order confirmation Voltage Controlled Records informs the purchaser about the approximate time of delivery. Voltage Controlled Records states this information on basis of the delivery information released by the specified shipper. Voltage Controlled Records does not guarantee to meet a special delivery date. Voltage Controlled Records is not responsible for goods sent not insured.




§5 Payment, Maturity and Default, Fees for Payment Transactions
1. All prices are given in EURO currency incl. 19% VAT. All prices are subject to be changed by Voltage Controlled Records at any time.
2. The purchaser can make payments only in advance by bank transfer or in advance by Paypal payment. Voltage Controlled Records only accepts payments made in EURO currency.
3. If the purchaser is in default of payment, Voltage Controlled Records shall be entitled to charge default interest at a rate of 5% per year over the base lending rate specified by the European Central Bank. If Voltage Controlled Records suffers a higher loss (e.g. due to return debit notes), Voltage Controlled Records can demand for reimbursement of the higher loss instead of default interest.
4. The amount invoiced is due for payment on receipt of the invoice which is attached to the delivered goods.
5. The purchaser has to take care of any charges that may accrue from international bank transactions. If the payment is made by Paypal Voltage Controlled Records will charge the purchaser a fee depending on the order value. Voltage Controlled Records will inform the purchaser about the fee in the order confirmation in advance.



§6 Set-off, Retention
The purchaser shall only be entitled to set-off, if his counter claims have been recognized in a legally effective manner or are uncontested by Voltage Controlled Records.

§7 Reservation Of Ownership
Until complete payment of the sales price has been effected, the delivered goods shall remain the property of Voltage Controlled Records.

§8 Liability for Defects
1. The legal provisions are valid for defects to the goods sold (§§ 434 ff BGB). It is forbidden to assign these claims to third parties. Unless otherwise stated hereunder, further claims on the part of the purchaser are excluded, e.g. compensation for any consequential harm caused by defective goods. Voltage Controlled Records is therefore not liable for any damages except for damages to the actual delivered goods.
2. Voltage Controlled Records emphasizes that in spite of all the extraordinary diligence taken with regard to the management of the range of products, it can not be excluded in individual cases that audio or video recordings or printed matter contain contents that are not conform with legal standards or contra bonos mores or morally harmful to young people. Voltage Controlled Records shall expressly assume no guarantee that no content of the above mention kind is contained in the delivered audio or video recordings or printed matter. The assertion of any claims for damages in this respect is excluded.
3. Voltage Controlled Records emphasizes that in spite of all the extraordinary diligence taken with regard to the management of the range of products, it can not be excluded in individual cases that audio or video recordings or printed matter have been produced which infringe on intelectual property rights or ancillary copyright. Voltage Controlled Records shall expressly assume no guarantee that the delivered audio or video recordings or printed matter do not infringe on intelectual property rights or ancillary copyright. The assertion of any claims for damages in this respect is excluded.
4. The disclaimers of warranty or limitation of liability specified in paragraphs 1 to 3 here in are also applicable to Voltage Controlled Records's employees, representatives and vicarious agents.
5. The disclaimers of warranty or limitation of liability specified in paragraphs 1 to 4 here in do not apply, if the damages result from intentional or grossly negligent breaches of duty or if personal injury is involved or if there has been an intentional or grossly negligent infringement or breach of moral standards. They are also not applicable, if the purchaser claims damages according to §§ 1 und 4 of the Product Liability Law.
6. In those cases where Voltage Controlled Records provides rectification in the form of replacement, the purchaser is obliged to return the originally delivered goods to Voltage Controlled Records at the expense of Voltage Controlled Records within 30 days of receipt of the replacement delivery.
7. Claims that are made as a result of defects become invalid after two years from the date of delivery to the purchaser.







§9 Data Protection
Personal data that Voltage Controlled Records has collected and recorded pertaining to the purchasers, solely serve the purpose of handling and processing the order including the realization of delivery or sales price, as well as the pursuance of any further claims that may result from this.


§10 Applicable Law
German law under exclusion of the UN Convention on Contracts For The International Sale Of Goods is applicable, irrespective of the purchasers seat or domicile.
